1. Acceptance of Terms

By accessing and using Beanotes ("the App"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the App.

2. Description of Service

Beanotes is a personal note-taking application designed to help you capture and organize thoughts about the important people in your life. The service includes:

  • Personal note creation and organization
  • Photo and moment capture
  • Relationship tracking
  • Encrypted cloud storage across your iOS devices
  • Collaborative note sharing with trusted contacts
  • Ask AI (Beta): On-device AI assistance for summarizing notes and answering quick questions about your content

3. User Accounts

To access certain features of the App, you may be required to create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

4. User Content

You retain all rights to the content you create and store in Beanotes ("User Content"). By using the App, you grant us the right to store, backup, and process your User Content solely for the purpose of providing the service to you.

You are solely responsible for your User Content and agree that you will not:

  • Upload content that is illegal, harmful, or violates others' rights
  • Use the App to harass, abuse, or harm others
  • Attempt to gain unauthorized access to the App or other users' data
  • Use the App for any commercial purposes without our consent

5. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

5a. Ask AI Feature (Beta)

The Ask AI feature is a beta feature that allows you to summarize notes and ask questions about your content. By using this feature, you acknowledge and agree to the following:

  • On-Device Processing: All AI processing is performed locally on your device. Your notes are never sent to external servers for AI analysis.
  • Cloud Data Access: Due to end-to-end encryption of notes stored in the cloud, you must explicitly mention (using @mentions) which people's notes you want to query when asking about cloud-stored content. Without mentions, only local data will be processed.
  • Name Detection: When no mentions are specified, the feature uses an on-device Named Entity Recognition (NER) model to detect names in your query and will only process local data.
  • Performance Impact: AI processing is CPU intensive and may affect device performance and battery life during use.
  • Limited Scope: This feature is designed for quick questions and summaries only, not extended conversations.
  • Beta Status: This is a beta feature and may contain errors or limitations. We are not liable for any inaccuracies in AI-generated responses.
  • No Data Collection: We do not collect, store, or transmit your queries or the AI responses. All processing remains on your device.

You should not rely solely on AI-generated summaries for important decisions. Always verify critical information by reviewing your original notes.

6. Subscription and Payment

Certain features of Beanotes may require a paid subscription. By subscribing, you agree to:

  • Pay all applicable subscription fees
  • Automatic renewal of your subscription unless canceled
  • Our right to change subscription prices with notice

Subscriptions are processed through Apple's App Store and are subject to Apple's terms and conditions. Refunds are handled according to Apple's refund policy.

7. Intellectual Property

The App, including its design, features, and functionality, is owned by Beanotes and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

8. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms of Service. Upon termination, you may export your data before your account is permanently deleted.

9. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF THE APP.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after such modifications constitutes acceptance of the updated terms.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
